Legal review draft

Terms and conditions

A service-specific starting point for legal review. Unconfirmed business terms are identified rather than invented.

Draft — operator approval and Indian legal review required.

Prepared 20 October 2026. Effective date: not approved. Operator: Parth Khandelwal. Address: awaiting confirmation. Privacy/grievance contact: support@niwaskhata.com. These pages are excluded from the search index while unapproved.

1. Status, operator and acceptance

These are review-draft terms for Niwas Khata’s PG/hostel management software, operated personally by Parth Khandelwal. The correspondence address and effective date remain unconfirmed. The public support address is listed on the contact page. The remaining details must be completed and reviewed before these terms are presented as an approved customer contract.

The service means the public website and supported management workspace. A business is the PG/hostel operation represented by its owner; a member is a person given a role in that workspace. Final acceptance and notice mechanisms should be reviewed with the operator’s legal adviser.

2. Eligibility and account creation

An owner should be an adult with authority to act for the relevant business. Use accurate account and business information, verify your email and choose your own password. The service does not independently certify the authority or age of every registrant.

Keep credentials private, maintain recovery access and assign team roles appropriately. An internal user identifier is generated by the authentication provider; it is not a password or a public credential.

3. Description of the software

Supported tools organize PG properties, rooms/beds, tenants, invoices, recorded payments, advances/deposits, expenses, occupancy and related reports, documents and operations. Features depend on the existing role and subscription controls.

Niwas Khata is not itself a landlord, broker, accommodation booking marketplace, police/identity-verification authority or payment gateway. It does not provide individualized legal, tax or accounting advice. A manual money entry does not execute a bank transfer, and a recorded KYC status is not independent verification.

4. Owner and tenant-data responsibilities

The business is responsible for the accuracy of entries, its agreements with residents, lawful property operations and applicable permissions/notices when collecting tenant information. Collect only necessary data and review staff access.

The allocation of legal roles between the business, operator and providers requires a suitable agreement and activity-specific review. This draft does not assign one legal role to every processing activity or waive residents’ applicable privacy rights.

5. Acceptable use and prohibited activity

Use the service for authorized management of your own business records. Do not access another workspace without authority, upload unlawful or unrelated personal information, share credentials improperly, attempt to bypass role controls, introduce malicious files or use the service to harass residents.

Support messages should exclude passwords, full identity documents and payment-card credentials. Private document tools are not a general public file-hosting service.

6. Trial and subscription price

The verified new-business configuration provides two calendar months free, followed by a choice of ₹299 per month or ₹2,999 per year for one business and its PGs. Yearly billing collects the full ₹2,999 once per year. Registration does not collect a payment card. Existing businesses are not automatically charged or enrolled merely because this marketing site exists.

When trial or paid access ends, records remain available to view and the existing controls require active access to add or change records. The operator is currently not GST-registered. No separate GST is charged on the listed subscription price. The current listed subscription prices are ₹299/month or ₹2,999/year. Any future price or tax change must be disclosed before payment. Invoicing and notice processes require review; no permanent price guarantee is offered.

7. Billing, renewal and cancellation

A Razorpay recurring-subscription implementation exists, but live merchant activation remains unconfirmed. A future checkout must display the amount, taxes, mandate and renewal terms before the customer authorizes payment. These terms do not authorize an automatic debit by themselves.

Where a subscription exists, the authenticated billing area provides a renewal cancellation action. Actual gateway status and paid-through access must be confirmed. Requesting account deletion does not itself cancel a recurring mandate. The operator must approve the final commercial cancellation policy before accepting paid customers.

8. Refunds and commercial policy changes

Refund eligibility, nonrefundability, processing periods and support details have not been approved. The separate refund-policy page marks these open decisions. No blanket promise of a refund or denial of statutory rights is made here.

Future changes to pricing or material contract terms require an appropriate approved notice and acceptance process. Existing paid coverage and applicable consumer rights must be considered rather than silently overridden.

9. Records, corrections and financial decisions

The business retains responsibility for its records and reconciliations. Check dates, amounts, property associations and references before relying on a report. Recorded cash flow is not necessarily accounting profit. Held deposits, advances and allocations should not be counted as rent receipts without the relevant agreement and evidence.

Supported edits and history help explain changes; they do not independently verify a bank transaction or correct every historical data problem. Keep supporting evidence and obtain professional advice when needed.

10. Data ownership, exports and deletion

Customers keep their interests in the business content they lawfully provide; the operator needs the permissions necessary to host and process it for the service. Final contractual licences and role allocation require legal review. No ownership of another person’s personal information is implied.

Authenticated CSV reports and browser Print / Save PDF are available for supported records. Account or business deletion is requested through a verified review workflow. Shared records, other members’ access, tenant rights, legal retention and provider backups require checks before deletion. No automatic complete-erasure promise or invented retention period is made.

11. Suspension and termination

Security incidents, unlawful use or a lack of authorized access may require restrictions. The operator must define a proportionate, reviewed suspension/termination and notice process, subject to applicable law. The present subscription expiry controls are not a general deletion mechanism.

Customers should review outstanding renewals and export permitted records when planning to leave. A request receipt means a request was saved, not that all services, mandates and shared records have already been terminated.

12. Intellectual property and third parties

Niwas Khata branding, software and original public-site content remain subject to their applicable intellectual-property rights. Customer-provided documents and third-party materials are governed by the relevant permissions. No licence to copy competitor brands or designs is provided.

The service uses hosted authentication/database/storage, hosting, SMTP and, when activated, payment providers. Their terms and availability may affect the service. No live native app-store listing is represented by the current mobile-web promotion.

13. Availability, maintenance and security

An internet connection is required. Maintenance and provider interruptions may affect access. No uptime percentage, guaranteed support response or uninterrupted service level has been verified for this draft.

Implemented authentication, role checks and private storage are safeguards, not an absolute-security guarantee. Customers should protect credentials and the operator must maintain appropriate configuration and incident processes. See the privacy-policy draft for the data-processing description.

14. Disclaimers and liability review

Reports depend on information entered and the supported software logic. They should be checked before making commercial decisions. This draft does not offer a guarantee of revenue, legal compliance, identity verification or the recovery of unpaid rent.

Any warranty exclusion, liability allocation, financial cap or indemnity must be reviewed for enforceability and fairness under applicable Indian law. No invented cap or waiver of non-excludable consumer or privacy rights is inserted here.

15. Disputes, governing law and contact

These terms are intended for an India-focused service. Applicable Indian law and non-excludable rights must be respected. The operator’s legal identity, jurisdiction details and a fair complaint/dispute procedure must be confirmed by legal counsel before a specific venue or arbitration clause is adopted.

Use the activated contact/request process for support and preserve the receipt. Approved legal/support contact details and an effective date remain required. This draft was prepared on 20 October 2026 and must not be presented as a completed legal review.
